Terms of Service
These Terms of Service ("Terms") govern your access to and use of the services on AV Police websites (the "Services"), and any information, text, graphics, opinions, or other materials uploaded, downloaded or appearing on the Services (collectively referred to as "Content"). You must read and agree to all the Terms before using the Services. By accessing or using the Services you agree to be bound by these Terms. We may change the Terms from time to time and it is your responsibility to review the Terms for any updates.
AV Police Service
The AV Police provides user reviews and ratings of audiovisual system installations based on questions and answers using simple observation. You provide an answer to every question that generates the report the Service creates. The reviews and ratings using the Service are your reviews and your ratings. You may choose to hire an independent franchise partner to perform the review for you.Basic Terms
You are responsible for your use of the Services, for any content you provide to the Services, opinions, and any consequences thereof. The data you submit, post, respond to, or display will become the property of the Services. The reviews created by using the Services are based on the information you have provided. The links to the reviews are only distributed by you. You agree to provide AV Police with true, accurate, current and complete information as prompted by the Service and update and maintain the truthfulness, accuracy and completeness of such information.
You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations. You may use the Services only if you can form a binding contract with AV Police and are not prohibited from receiving services under the laws of the United States or other applicable jurisdictions.
The Services that AV Police provide are always growing and expanding, the form and nature of the Services that AV Police provide may change and you may not receive prior notice. In addition, AV Police may stop providing the Services, or any features within the Services, to you and may not be able to provide you with prior notice. The Services may include advertisements, which may be targeted to the Content or information on the Services, queries made through the Services, or other information. The types and extent of advertising by AV Police on the Services are subject to change. In consideration for AV Police granting you access to and use of the Services, you agree that AV Police and its third party providers and partners may place such advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others.
The AV Police limits the storage of archived information to one year. The AV Police reserves the right to request renewal fees for storage of any reports older than one year. Reports that have not been renewed after one year are subject to deletion and removal from the Services. AV Police will not be held responsible for data that has been deleted after one year.
AV Police uses a network of franchise partners to provide onsite services. The franchise partners do not work for AV Police. We do not guarantee that the franchise partners are either capable or willing to complete your service needs. Although we take certain steps to examine the credentials of our listed franchisee's, we make no guarantees or representations regarding the skills or representations of such service professional or the quality of the job that he or she may perform for you. AV Police does not guarantee or warrant the pricing or discounts that a franchisee may offer you. Any quotes provided by the AV Police via the AV Police website are not contractually binding offers, are for informational purposes only, and cannot be accepted on or via the AV Police website. No contractual arrangement is created based upon the quotes provided to you from franchisee's (or your scheduling of a visit by a franchise partner) via the AV Police website. To contract with a franchisee, you must work directly with the franchisee. AV Police does not endorse or recommend the services of any particular franchisee. It is entirely up to you to enter into a direct contract or otherwise reach agreement with a franchisee, and we do not guarantee or warrant their reviews of the work or the outcome or quality of the review performed. The franchisees are not employees or agents of AV Police, nor is AV Police an agent of the franchisee. AV Police does not perform, and is not responsible for, any of the services requested by you in your onsite review request. Your rights under contracts you enter into with franchisees are governed by the terms of such contracts and by applicable federal, state, provincial and local laws. Should you have a dispute with any franchisee, you must address such dispute with the franchisee, AND YOU HEREBY AGREE TO RELEASE AV POLICE (AND OUR OFFICERS, DIRECTORS, AFFILIATES, EMPLOYEES AND AGENTS) AND ANY OTHER PERSON, FIRM, OR ENTITY (INCLUDING OUR BUSINESS PARTNERS) FROM ANY DAMAGES OR CLAIMS (INCLUDING CONSEQUENTIAL AND INCIDENTAL DAMAGES) OF EVERY KIND OR NATURE, SUSPECTED AND UNSUSPECTED, KNOWN AND UNKNOWN, AND DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES AND YOUR DEALINGS WITH AV POLICE FRANCHISE PARTNERS.
If You are under the age of eighteen (18), You are prohibited from using or registering for the Service.
You are solely responsible for maintaining and protecting the confidentiality of Your user ID and password, and are fully responsible for all activities that occur under Your user ID and password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. The AV Police cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.
Content on the Services
All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk.
We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. Under no circumstances will AV Police be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere.
You retain your rights to any Content you submit, post or display on or through the Services. By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed).
We may modify or adapt your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media.
AV Police Rights
All right, title, and interest in and to the Services (excluding Content provided by users) are and will remain the exclusive property of the AV Police and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. The Terms do not give you a right to use the AV Police name or any of the AV Police trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding AV Police, or the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.
The Services are Available "AS-IS"
You understand and agree that the Services are provided to you on an "AS IS" and "AS AVAILABLE" basis. Your access to and use of the Services or any Content is at your own risk. Without limiting the foregoing, AV Police AND ITS PARTNERS DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of the Services or any content thereon. AV Police will not be responsible or liable for any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services, or any Content. You also agree that AV Police has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Services. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from AV Police or through the Services, will create any warranty not expressly made herein.
Resolution of Disputes
Because of the nature of the AV Police websites providing reviews disputes are likely to arise. The review process and scoring by the AV Police website may result in reports that do not reflect your opinion of the work that was performed. The information provided for the reviews is provided by you or your service provider, AV Police does not default any answer to a response. Every question must be answered to provide an accurate report. Before any report is made available to anyone besides the person creating the report, we encourage you to thoroughly review the content of the report. Each question that is asked provides information that will be reflected in the report. You can makes changes at any time to the answers to the questions. We ask for your honest input and response to each question. If you still do not agree with the review after changing your answer please contact AV Police at email@example.com we will review the question that generated the response and your opinion of the answers.
The AV Police reviews are not legally binding. The AV Police reviews are not intended to be used in a court of law, in any country. The AV Police are providing an open forum and review process to assist service providers and end users with a means to show the quality of work performed. The questions that are answered to create the reports are answered by someone other than the AV Police and the AV Police will not support or support any of the answers for any reason of conflict resolution.
The Services may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by AV Police of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AV POLICE AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT AV POLICE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
